Starting from 1 January 2021 (following the end of the Brexit transition period) the UK is no longer subject to EU state aid law. Instead, the UK is subject to a new subsidy control regime.
At the time of writing (March 2022):
- the new subsidy control regime in the UK is, from a local authority’s perspective, primarily governed by Chapter 3 of Title XI of the UK-EU Trade and Cooperation Agreement (“TCA”)
- the new Subsidy Control Bill is going through the parliamentary process before it can reach the statute books.
The new rules in the TCA contain transparency requirements – namely, the need to for the public body who gives a permitted subsidy to publish certain information about that. This also involves publishing certain information on our website.
This webpage is therefore set up to publish certain information in relation to any subsidies granted by the council under the new rules, specifically:
- the purpose of the subsidy
- the categories of beneficiary
- the terms and conditions of eligibility for the subsidy and the basis for the calculation of the subsidy (including any relevant conditions relating to subsidy ratios or amounts).
