When buying land or property, it is normal to carry out a search of the highway records in the vicinity of the land or property.

The list of streets is the list of publicly maintainable highways, and in Warwickshire this comes in two parts:

  • Streets
  • The definitive map and statement of public rights of way

(N.B. There is some overlap of these records, so it is advisable to check both.)

Searches of these records are normally carried out as part of the CON29 form, which is submitted by a solicitor on behalf of a client. The rights of way question on this form is optional, but we recommend that it is carried out in most cases, as the situation on the ground does not always reflect the legal record.
