The competition is run by Warwickshire County Council (WCC), of Shire Hall, Warwick CV34 4RL, through Warwickshire Fire and Rescue Service (WFRS). For the purposes of these terms and conditions, any reference to 'WFRS' shall mean Warwickshire Fire and Rescue Service, which is a part of WCC. By entering the competition outlined in the competition details on the promotional poster (the 'Competition'), entrants agree to be bound by the following terms and conditions.
1. Eligibility
1.1 The eligibility requirements are outlined in the Competition information on the promotional poster.
2. How to Enter
2.1 The entry information is outlined in the Competition information on the promotional poster.
2.2 All Competition entries must be received by WFRS by no later than 5pm on the closing date. All Competition entries received after the closing date are automatically disqualified.
2.3 Each entry must include the entrant's full name, age, key stage, and school (if applicable), and a contact email or phone number for a parent or guardian.
2.4 The Competition is limited to one entry per entrant. Only the first entry from an entrant will be judged, any subsequent entry will be disqualified.
2.5 By submitting an entry to the Competition, the entrant confirms and warrants that they are the original creator of the entry and solely hold all intellectual property rights of the entry. This means that the entry must be original and must not be copied from someone else.
2.6 The entry will be removed or refused if it appears (at the sole discretion of WFRS) to have been created in such a way that any law may have been broken or that the entry has otherwise been created in an irresponsible way.
2.7 WFRS reserves the right to remove or refuse any entry from the Competition for any reason.
3. Selection and Prize
3.1 Any winning design may be shared with Warwickshire schools, featured on WCC and WFRS social media channels, newsletters and displayed at local fire stations. Any winning design may be disclosed to the media in connection with any relevant press releases or other communications at the sole discretion of WFRS.
3.2 Winner(s) may be awarded a prize as part of the Competition (the “Prize”), the nature and value of the Prize shall be determined at WFRS’ sole discretion.
3.3 The winner(s) may be invited to tour a Warwickshire fire station and learn more about the role and responsibilities of firefighters as part of the Prize.
3.4 The Prize is non-transferable and non-negotiable. There is no alternative Prize available. However, WFRS reserve the right to substitute a similar Prize in the event of the Prize being unavailable for any reason.
3.5 WFRS shall not be liable for any claims or complaints of any nature in respect to the Prize, to the fullest extent that this is permissible by law.
4. Judging and Winner Notification
4.1 Judging will be conducted by WFRS, whose decision is final and not subject to appeal.
4.2 Winner(s) will be notified in writing using the contact details provided with their entry.
4.3 Should a winner not acknowledge receipt of their win within seven (7) days of receiving notice that they have won the Competition, WFRS reserve the right to select another winner and award the Prize to another entrant or not fulfil the Prize.
5. Publicity and Usage Rights
5.1 The entrant will remain the copyright owner of any entry submitted.
5.2 By entering, participants grant WFRS the right to use and display any winning design in any medium, including print and digital, and on any media, along with the entrant’s first name, the entrant’s school for any purpose related to the Competition and publicity purposes on social media, websites, newsletters, local media, fire station displays, and in communications with schools located in Warwickshire.
5.3 If the entrant prefers not to have their name and/or the entrant’s name of school used publicly, then the entrant must inform WFRS in writing when submitting their entry.
6. Liability
6.1 WFRS is not liable for any loss or damage, to entries submitted via post.
6.2 WFRS accepts no liability for any technical issues preventing entries from being received by the closing date.
6.3 Travel or any additional costs related to claiming or participating in the Prize shall be the responsibility of the winner.
6.4 WFRS excludes its liability for any loss, damage, injury, cost, or expense, suffered by the entrant, whether directly or indirectly and howsoever caused, in connection with the Competition.
6.5 Nothing in these terms and conditions shall exclude WFRS’ liability for death or personal injury arising from WFRS’ own negligence or any other liability that cannot, as a matter of law, be excluded.
7. Data Protection
7.1 Personal data provided for the Competition will only be used for purposes related to the Competition, unless otherwise consented to by the entrant’s parent or guardian.
7.2 Personal data will be securely stored and managed by WFRS in accordance with the Data Protection Act 2018, UK General Data Protection Regulation (“UK GDPR”) and any other applicable law relating to the processing of personal data.
7.3 WFRS will only process personal data in accordance with these terms and conditions for the Competition and WFRS Privacy Notice (as amended from time to time).
8. Right to Amend
8.1 WFRS reserves the right to modify or withdraw the Competition and its terms and conditions in the event of unforeseen circumstances or as deemed necessary at its discretion.
8.2 If any entrant is found to have breached these terms & conditions, then WFRS reserve the right to exclude the entrant from participating in the Competition.
8.3 If a breach of these terms and conditions has occurred, but is discovered after the award of a Prize, then the winner will be required to forfeit the Prize, WFRS reserve the right to award the Prize to another entrant or not fulfil the Prize.
8.4 Any changes to the terms and conditions will be communicated via the WFRS communication channels.
9. Governing Law
9.1 These terms and conditions are governed by English law. If any entrants to this Competition wish to take court proceedings, then they must do this within the courts in the United Kingdom.
